年假未休工資怎么計(ji)算
國務(wu)院(yuan)《職工(gong)(gong)帶(dai)薪(xin)年(nian)休(xiu)假條例》賦予(yu)了職工(gong)(gong)帶(dai)薪(xin)休(xiu)假的權(quan)利(li)。《條例》規定,機關、企(qi)事業單位(wei)職員連續工(gong)(gong)作1年(nian)以上的,都(dou)可以享受帶(dai)薪(xin)年(nian)休(xiu)假。按照(zhao)工(gong)(gong)作時間年(nian)限(xian)不同,休(xiu)假天(tian)數也不同。而(er)對應休(xiu)而(er)未休(xiu)的年(nian)休(xiu)假天(tian)數,單位(wei)應當按照(zhao)職工(gong)(gong)日工(gong)(gong)資(zi)(zi)的300%支付年(nian)休(xiu)假工(gong)(gong)資(zi)(zi)報酬。《企(qi)業職工(gong)(gong)帶(dai)薪(xin)年(nian)休(xiu)假實施(shi)辦(ban)法》第五(wu)條、第十一條、第十二條的規定,計算帶(dai)薪(xin)年(nian)假工(gong)(gong)資(zi)(zi)應扣除加班費。
1、第五(wu)條職工新進用人單位(wei)且符合(he)本(ben)辦法(fa)第三條規定(ding)(ding)的(de)(de),當(dang)年(nian)度(du)年(nian)休(xiu)(xiu)(xiu)假天(tian)(tian)(tian)數,按照在(zai)(zai)本(ben)單位(wei)剩余日(ri)歷(li)天(tian)(tian)(tian)數折算確(que)定(ding)(ding),折算后不足1整天(tian)(tian)(tian)的(de)(de)部(bu)分不享受(shou)(shou)年(nian)休(xiu)(xiu)(xiu)假。前款規定(ding)(ding)的(de)(de)折算方法(fa)為:(當(dang)年(nian)度(du)在(zai)(zai)本(ben)單位(wei)剩余日(ri)歷(li)天(tian)(tian)(tian)數÷365天(tian)(tian)(tian))×職工本(ben)人全年(nian)應當(dang)享受(shou)(shou)的(de)(de)年(nian)休(xiu)(xiu)(xiu)假天(tian)(tian)(tian)數。
2、第十一條計(ji)(ji)算(suan)未休(xiu)年休(xiu)假工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)資(zi)(zi)(zi)報酬的(de)(de)日工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)資(zi)(zi)(zi)收入(ru)按(an)照(zhao)職(zhi)(zhi)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)本人的(de)(de)月(yue)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)資(zi)(zi)(zi)除以月(yue)計(ji)(ji)薪天(tian)數(21.75天(tian))進(jin)行折算(suan)。前(qian)(qian)款(kuan)所稱月(yue)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)資(zi)(zi)(zi)是指職(zhi)(zhi)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)在(zai)用人單位支付(fu)其(qi)未休(xiu)年休(xiu)假工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)資(zi)(zi)(zi)報酬前(qian)(qian)12個月(yue)剔除加班工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)資(zi)(zi)(zi)后的(de)(de)月(yue)平均(jun)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)資(zi)(zi)(zi)。在(zai)本用人單位工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)作時間不(bu)滿(man)12個月(yue)的(de)(de),按(an)實(shi)(shi)際(ji)月(yue)份計(ji)(ji)算(suan)月(yue)平均(jun)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)資(zi)(zi)(zi)。職(zhi)(zhi)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)在(zai)年休(xiu)假期間享(xiang)受與正常工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)作期間相同的(de)(de)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)資(zi)(zi)(zi)收入(ru)。實(shi)(shi)行計(ji)(ji)件(jian)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)資(zi)(zi)(zi)、提成(cheng)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)資(zi)(zi)(zi)或者其(qi)他績效(xiao)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)資(zi)(zi)(zi)制的(de)(de)職(zhi)(zhi)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong),日工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)資(zi)(zi)(zi)收入(ru)的(de)(de)計(ji)(ji)發(fa)辦法按(an)照(zhao)本條第一款(kuan)、第二款(kuan)的(de)(de)規(gui)定(ding)執行。

職工累計(ji)工作已(yi)滿(man)(man)1年(nian)(nian)(nian)(nian)不滿(man)(man)10年(nian)(nian)(nian)(nian)的,年(nian)(nian)(nian)(nian)休(xiu)假(jia)5天;已(yi)滿(man)(man)10年(nian)(nian)(nian)(nian)不滿(man)(man)20年(nian)(nian)(nian)(nian)的,年(nian)(nian)(nian)(nian)休(xiu)假(jia)10天;已(yi)滿(man)(man)20年(nian)(nian)(nian)(nian)的,年(nian)(nian)(nian)(nian)休(xiu)假(jia)15天。國(guo)家法定休(xiu)假(jia)日、休(xiu)息日不計(ji)入年(nian)(nian)(nian)(nian)休(xiu)假(jia)的假(jia)期。
