  按份(fen)共(gong)(gong)有人(ren)處分共(gong)(gong)有的(de)房屋(wu)以及對共(gong)(gong)有的(de)房屋(wu)作重大修繕(shan)的(de), 應當經(jing)占(zhan)份(fen)額三分之二以上的(de)按份(fen)共(gong)(gong)有人(ren)同意,但共(gong)(gong)有人(ren)之間另(ling)有約定的(de)除外。

  (4)共(gong)有房屋的分割

  按份(fen)共(gong)(gong)有(you)(you)(you)(you)(you)(you)中(zhong),共(gong)(gong)有(you)(you)(you)(you)(you)(you)人(ren)(ren)若(ruo)有(you)(you)(you)(you)(you)(you)約定(ding)不(bu)得(de)分(fen)(fen)(fen)割(ge)共(gong)(gong)有(you)(you)(you)(you)(you)(you)房屋(wu),以(yi)維持共(gong)(gong)有(you)(you)(you)(you)(you)(you)關系的,應(ying)當按照約定(ding),但共(gong)(gong)有(you)(you)(you)(you)(you)(you)人(ren)(ren)有(you)(you)(you)(you)(you)(you)重大(da)理由(you)需要分(fen)(fen)(fen)割(ge)的,可(ke)以(yi)請求分(fen)(fen)(fen)割(ge);沒有(you)(you)(you)(you)(you)(you)約定(ding)或者約定(ding)不(bu)明確的,按份(fen)共(gong)(gong)有(you)(you)(you)(you)(you)(you)人(ren)(ren)可(ke)以(yi)隨(sui)時請求分(fen)(fen)(fen)割(ge),因(yin)分(fen)(fen)(fen)割(ge)對其他共(gong)(gong)有(you)(you)(you)(you)(you)(you)人(ren)(ren)造成(cheng)損害的,應(ying)當給予(yu)賠償(chang)。

  (5)共有人之間及(ji)其與第三人間的(de)關系
