  《勞(lao)(lao)(lao)動(dong)(dong)(dong)法》第十七條二款規定(ding)(ding):勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)依(yi)法訂(ding)立即具(ju)有(you)法律約束(shu)力,當事(shi)(shi)人(ren)必須(xu)履行勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)規定(ding)(ding)的義(yi)務。勞(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)既已與一家企業(ye)簽訂(ding)了勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)(tong),就必須(xu)承擔(dan)為企業(ye)工(gong)作的義(yi)務。只(zhi)有(you)在法定(ding)(ding)的條件具(ju)備時(shi),勞(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)才可(ke)以(yi)不再承擔(dan)此項義(yi)務。《勞(lao)(lao)(lao)動(dong)(dong)(dong)法》第二十四(si)條規定(ding)(ding):經勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)當事(shi)(shi)人(ren)協商一致(zhi),勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)可(ke)以(yi)解除。第三十一條又規定(ding)(ding)勞(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)解除勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)(tong),應當提前三十日以(yi)書(shu)面形式(shi)通(tong)知用人(ren)單位。

  綜(zong)上(shang)所述,不僅勞(lao)(lao)動(dong)(dong)者(zhe),而(er)且與其簽(qian)訂勞(lao)(lao)動(dong)(dong)合同(tong)(tong)的另(ling)一家(jia)公司,亦應承擔違(wei)約(yue)(yue)賠償責(ze)任。《勞(lao)(lao)動(dong)(dong)法(fa)》第九(jiu)十九(jiu)條(tiao)規(gui)(gui)定:用(yong)(yong)人(ren)(ren)單(dan)位(wei)(wei)招用(yong)(yong)尚未解除勞(lao)(lao)動(dong)(dong)合同(tong)(tong)的勞(lao)(lao)動(dong)(dong)者(zhe),對原用(yong)(yong)人(ren)(ren)單(dan)位(wei)(wei)造成(cheng)經濟損(sun)失的,該用(yong)(yong)人(ren)(ren)單(dan)位(wei)(wei)應當依法(fa)承擔連帶(dai)賠償責(ze)任。根據這一法(fa)律(lv)規(gui)(gui)定,勞(lao)(lao)動(dong)(dong)者(zhe)原單(dan)位(wei)(wei)要求勞(lao)(lao)動(dong)(dong)者(zhe)和另(ling)一家(jia)公司承擔違(wei)約(yue)(yue)賠償責(ze)任,理應得到仲(zhong)裁委員會(hui)的依法(fa)支持。

  還應當指出,仲裁委員會亦有權(quan)依法確認勞(lao)(lao)動(dong)者(zhe)與后一家公司所簽(qian)訂的勞(lao)(lao)動(dong)合同(tong)無效(xiao),并裁決勞(lao)(lao)動(dong)者(zhe)繼續履(lv)行與原企業訂立的勞(lao)(lao)動(dong)合同(tong)。
